What are personal data?
Personal data are information relating to individuals whose identity is identified or identifiable (such as name, address, date of birth, telephone number, email address, etc).
What personal data do we process from you and where do we obtain this data?
We process your personal data that we receive in the context of the business relationship with you. These personal data include the following data that we receive directly from you:
- Your personal details (name, address, date of birth, telephone number, email address, etc)
- Your identification data (e.g., identification card data)
- Product, service, and contract data as well as processing results for the fulfillment of contracts and consents
- Order data (e.g., payment orders)
- Documentation data (e.g., consultation protocols)
For what purposes and on what legal basis are the data processed?
We process your personal data for the following purposes:
- For the performance of pre-contractual measures or for the fulfillment of our contractual obligations (Art 6 para 1 lit b GDPR) within the scope of the business relationship;
- Based on and to the extent of your given consent (Art 6 para 1 lit a GDPR) if you have given us your respective consent;
- To fulfill our legal obligations (Art 6 para 1 lit c GDPR).
The processing of your data serves to establish and conduct our business relationship or to execute the respective contract/order.
If consent is required for processing, we will obtain it. Consents are always voluntary. If you have given us consent to process your personal data for specific purposes, processing will be based on this consent according to the purposes specified in the consent declaration and to the extent agreed therein. A given consent can be revoked at any time with effect for the future in writing or by email to <office „at“ assistronik.info>. This does not affect the lawfulness of the data processing carried out up to that point.
You are not obliged to give consent for the processing of data that is not relevant or necessary for the fulfillment of the contract or the specific contract/order.
Are you obliged to provide your personal data? What happens if you do not want to?
For our business relationship and the execution of our business relationship, we rely on your personal data. If you do not provide us with the relevant data, we generally have to reject the conclusion of a contract or the execution of the order, or we cannot continue to execute an existing contract and must therefore terminate it.
Are your data disclosed?
We will only disclose your data to the extent necessary to achieve the purpose.
Within our company, only those departments or employees receive your data who need it to fulfill contractual and/or legal obligations or for processing within the scope of your consent.
To achieve the stated purposes, it may be necessary for your personal data to be disclosed to the following recipients. This disclosure may be by transmission, dissemination, or any other form of provision.
- IT companies for the provision, maintenance, and support of our IT system as well as for the IT-related processing of the purpose of data processing;
- Tax consultants and auditors for the purpose and in the interest of support in fulfilling our tax obligations (UGB, BAO, etc);
- Insurance companies or request portals for insurance claims, for claims processing and billing to these, as well as for the handling of our insurance claims;
- Legal representatives, security authorities, competent courts, or authorities for legal enforcement or tax authorities;
- Banks;
- Warranty providers (importers or sub-dealers) for the purpose of fulfilling the warranty contract;
- Other third parties, if this is mandatory for the fulfillment of the contract or due to legal requirements;
- Freight forwarders or delivery services
Some of the above-mentioned recipients may be located outside your country or may process your personal data there. The level of data protection in other countries may not correspond to that of your country. However, we only transfer your personal data to countries for which the European Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection.
How long do we keep your personal data?
We will only store your data for as long as is necessary for the purpose for which we collected your data. In any case, we store your personal data as long as legal retention obligations (including UGB, BAO, etc) exist or statutory limitation periods of potential legal claims (up to 30 years) have not yet expired. After these periods have expired, the data will be irretrievably deleted.
Do we use decision-making based on automated processing – e.g., profiling?
We do not use automated decision-making, including profiling within the meaning of Art 22 GDPR.
What rights do you have regarding data processing?
Under applicable law, you are entitled, among other things,
- to check whether and what personal data we process about you and to receive copies of this data,
- to request the correction, supplementation, or deletion of personal data that is incorrect or processed unlawfully,
- to request us to restrict the processing of personal data,
- to object to the processing of personal data,
- to request data portability, and
- to know the identity of third parties to whom the personal data are transmitted.
If we process your data based on your consent, you have the right to revoke this consent at any time by email to <office „at“ assistronik.info> or by post to Assistronik, Markgraf-Rüdigerstraße 15/24, 1150 Vienna. This does not affect the lawfulness of the data processing carried out up to that point.
In addition, you have the right to lodge a complaint with the Austrian Data Protection Authority or another data protection supervisory authority in the EU, in particular at your place of residence or work.
